By opting in to or using the ETHO text message service (the “Text Service”), you accept these Terms & Conditions and agree to the Privacy Policy described below.
Opting In
From time to time, Just Ethos Online may advertise the opportunity to participate in the Text Service and receive alerts and information via text message from Just Ethos Online, which promotes leadership development and other business skills. You acknowledge and agree that you are opting into the Text Service by signing up online after you have registered for an account.
By optin in:
- • You authorize Just Ethos Online to use autodialer technology to send text messages to the cell phone number associated with your opt in (i.e., the number from which you send the opt in request). You do not have to opt-in or agree to opt-in as a condition of purchase.
- • You confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt-in.
- • You consent to the use of an electronic record to document your opt-in.
Opting Out and Assistance
You may opt out of the ETHO service at any time by texting STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to 55090. Alternatively, you can send an email to [email protected] with your mobile phone number as the subject line. You can also text HELP to 55090 from your mobile phone or call our toll free number 1855 922 7263.
Message and data rates may apply. Unless otherwise noted, Just Ethos Online may send multiple, recurring messages and/or terminate the Text Service or your participation in it at any time with or without notice, including, for example, before you have received any or all messages that you otherwise would have received.
Privacy
Just Ethos Online respects and protects your privacy. We do not share any information collected. You consent to the handling of your information as described in the Just Ethos Online Privacy Statement available at www.justethosonline.com/privacy-policy. Limitations on Use
You must be at least 17 years old to register for and use the ETHO service. If you are under 17 years old, please obtain your parents’ permission before you sign up for the ETHO service.
Supported Carriers
Our participating carriers include (but not limited to) AT&T, Sprint, Verizon Wireless, U.S. Cellular, T-Mobile, MetroPCS. Carriers are not liable for delayed or undelivered messages to the customer. If your mobile operator is not participating, you will not receive a reply to your messages. Some operators may not support some services at the prices offered. Pre-paid users may not be able to participate – check with your mobile operator.
Termination
Just Ethos Online reserves the right, at our sole discretion, to terminate your subscription at any time without notice or without future obligation.
Disclaimer of Warranties
Just Ethos Online makes no warranties, express or implied regarding the ETHO service. The ETHO service is provided “as is” and on an “as available” basis, and Just Ethos Online DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Factors beyond the control of Just Ethos Online including without limitation, the speed of the mobile carrier networks and the internet may affect the performance of the ETHO service. Just Ethos Online is not responsible for any acts that are beyond the control of Just Ethos Online.
Limitation of Liability
Under no circumstances will Just Ethos Online, its officers, directors, employees, or agents be liable to you for any damages whatsoever with respect to your use of the ETHO service. Including without limitation, any direct, indirect, incidental, consequential, exemplary or special damages even if advised of the possibility of the same. To the extent that in a particular circumstance any disclaimer or limitation on damages or liability set forth herein is prohibited by applicable law, then, instead of the provisions hereof in such particular circumstance, Just Ethos Online will be entitled to the maximum disclaimers and/or limitations on damages and liability available at law or in equity by such applicable law in such particular circumstance, and notwithstanding the foregoing, in no event will Just Ethos Online be liable for any damages or liability arising under these terms of use or your use of the ETHO service that exceeds US $500.
Indemnity
You agree to indemnify and hold each Company party harmless from any claim or demand, and any damages, costs, or expenses arising in connection with such claim or demand, including reasonable attorneys’ fees and costs, made by any other party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the right of another party.
Governing Law
Any dispute arising from these Terms or your access to or participation in the Text Service will be governed by and construed and enforced in accordance with the laws of Texas, without regard to conflict of law rules or principles.
